The US Federal Trade Commission has recently implemented rules for private investment funds and investment advisers that are not registered with the Securities and Exchange Commission. These rules are designed to protect customers' non-public personal information. Dechert discusses what this means for the private equity industry.
The rules as set out by the Federal Trade Commission require private equity funds to adopt written privacy procedures and to provide investors with an annual notice of the fund's privacy policies and procedures. The rules are not specific to the private equity industry, as they also cover other private investment companies, such as hedge funds.
