On 15 May 2002, a bill intended to regulate mergers and acquisitions in the telecommunications market was presented to the legislative council in Hong Kong. Freshfields Bruckhaus Deringer discusses the new regulations and the effects they may have.
The main section of the new bill grants the Telecommunications Authority (TA) the power to order a carrier licensee to act to eliminate any actual or likely anti-competitive effects of a change in its ownership or control. This could have dramatic effects on M&A in the telecoms market in the region.
